By creating an account, subscribing to a plan, or using the service, you agree to these Terms and Conditions. If you do not agree, do not use SmartScraping.
SmartScraping may fetch publicly accessible web content and process it into data according to the URL, schema, and other instructions submitted by you. The service may use third-party infrastructure, hosting providers, payment processors, artificial intelligence services, proxies, and website operators. Features, plans, usage limits, pricing, and availability may change at any time.
You are responsible for your requests, API keys, account credentials, and all data obtained or processed through your account. You must use SmartScraping lawfully and respect robots.txt directives, website terms of use, access restrictions, intellectual property rights, privacy rights, and applicable data protection laws. You must not use the service to bypass authentication or security controls, access private or restricted information, overload or disrupt websites, commit fraud, send spam, or collect sensitive personal data without a lawful basis and any required consent.
SmartScraping does not guarantee that scraped content is complete, current, accurate, available, or suitable for any particular purpose. AI-generated or automatically extracted results may contain errors, omissions, or unsafe content and must be reviewed by you before use. You are solely responsible for verifying results and for your use of any third-party content. SmartScraping does not control, endorse, or assume responsibility for third-party websites or their content.
SmartScraping is provided on an “as is” and “as available” basis. Because the service is operated by a single independent operator and depends on third-party providers and external websites, uninterrupted or error-free operation is not guaranteed. The service may be delayed, limited, suspended, changed, or unavailable because of maintenance, outages, rate limits, provider failures, network problems, security incidents, legal requirements, or circumstances beyond reasonable control. No service level agreement, uptime commitment, or guaranteed response time is provided unless expressly agreed in writing.
You must provide accurate information and keep your credentials and API keys confidential. You are responsible for all activity under your account and must promptly notify SmartScraping of unauthorized access. SmartScraping may suspend or terminate accounts that violate these Terms, create risk to the service or others, or remain unpaid.
Paid plans are billed through the payment provider shown at checkout. You authorize the applicable charges, including recurring charges where relevant, until you cancel. Usage limits and plan features apply as displayed when you subscribe. Unless required by law or expressly stated otherwise, payments are non-refundable, including for unused credits, failed scraping attempts, provider outages, or account termination. You may cancel future renewals through the available account or billing controls; cancellation does not automatically reverse charges already made.
SmartScraping and its original software, branding, and documentation remain the property of SmartScraping or its licensors. You retain rights to content and instructions that you submit, subject to the rights needed to operate the service. You represent that you have the right to submit that material and authorize its processing. You should not submit confidential, regulated, or sensitive information unless you have assessed the risks and have a lawful basis to do so. Personal data will be handled in accordance with applicable data protection laws and any privacy notice published by SmartScraping.
To the fullest extent permitted by law, SmartScraping disclaims all express or implied warranties, including warranties of availability, merchantability, fitness for a particular purpose, non-infringement, security, accuracy, and uninterrupted operation. You use the service at your own risk and are responsible for maintaining independent backups and safeguards.
To the fullest extent permitted by law, SmartScraping and its operator will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, business, data, goodwill, or anticipated savings, arising from or related to the service or these Terms, even if advised of the possibility of such damages. To the fullest extent permitted by law, the total liability of SmartScraping and its operator for all claims will not exceed the amount you paid to SmartScraping for the service during the three months preceding the event giving rise to the claim. Nothing in these Terms excludes liability that cannot legally be excluded or limited.
You agree to defend, indemnify, and hold harmless SmartScraping and its operator from claims, damages, liabilities, costs, and expenses arising from your use of the service, your breach of these Terms, your violation of law or third-party rights, or content and data submitted through your account.
You may stop using the service at any time. SmartScraping may suspend or terminate access, remove data, or discontinue any feature at any time, including where reasonably necessary to protect the service, comply with law, address abuse, or manage operational constraints. Provisions that by their nature should survive termination, including payment obligations, disclaimers, limitations of liability, and indemnification, will survive. SmartScraping may update these Terms from time to time. Continued use after an update means that you accept the revised Terms.
